Sub: Public Hearing on the matter of “Child Labour, RTE and other Child Rights issues” at sardar Patel Institute of Public Administration, Ahmedabad, Gujarat on 27-28 January, 2012 to be organized by National Commission for Protection of Child Rights(NCPCR)-reg.

Sir,
I am directed to refer to your letter dated 20.1.2012 as well as to the letter dated 19.1.2012 of the Principal Secretary (Labour) as addressed to the Chairperson (NCPCR) on the above cited subject and to convey that NCPCR follows its own procedure in carrying out its activities and is not required by law to be guided by NHRC procedure.

2. However, the proposed public hearing of NCPCR on 27th and 28th January, 2012 is postponed to a future date after one month, considering the time solicited by the State Government for looking into each case / matter / grievance referred to it.

3. It is clarified that the public hearings held by NCPCR is a methodology adopted to reach to as many children as possible. It provides platform to the Commission as well as to the Government to see how together the grievances of the affected children can be addressed.

4. In the meantime, Action Taken Report (ATR) in concrete terms in each case (as referred to vide this Commission’s letter of even number dated 12.1.2012) may be furnished to this Commission by 20.02.2012.

5. The State Government is also requested to ensure that nobody (the child, parents / family members / NGO representative) involved in the referred cases harassed by anybody directly or indirectly.

6. The concerned Departments and District Magistrates / Collectors may be informed accordingly.

7. This issues with the approval of Chairperson (NCPCR).
